When you ask for your vacation booking to be confirmed, you are accepting that these Terms and Conditions form the basis of any contract between Vision The Atlantic Canada Co. and yourself, which is subject to Canadian Law and the exclusive jurisdiction of the Canadian Courts.
A deposit of 20% (unless a specific amount is stated) is required when you make your booking. The balance must be paid at least 6 weeks (unless specified otherwise) before travel. If you are booking within 6 weeks of travel full payment is due immediately. Alteration or cancellation of the booking by you, once a confirmation of booking has been issued, will be subject to the provisions of alteration and Cancellation below.
ALTERATIONS TO A CONFIRMED BOOKING
If you decide to alter any details of your booking after it has been accepted by Vision The Atlantic Canada Co. you must advise the company in writing by fax, e-mail or mail. Provided we are advised more than 4 weeks prior to departure, we will endeavour to make the changes and limit the administration fee to $20 per person up to a maximum of $100. Alterations within 4 weeks of travel, changes to flight dates, and alterations to the names of people travelling may be treated as cancellation.
If you do not pay the balance of the vacation at the prescribed time, Vision The Atlantic Canada Co. reserves the right, after due notice to you, to cancel the booking. In this event, or if you cancel after the booking is accepted, the deposit will be forfeited. Additionally if cancellation occurs after the deposit and/or balance has been received by us, the following cancellation charges will be payable by you. The following cancellations apply for cancellations due to Force Majeure. Dates are calculated from the date on which Vision The Atlantic Canada Co. receives written notice of the cancellation or when the Force Majeure comes into effect.
• Prior to 60 days – Deposit
• 15 – 59 days – 30%
• 8 – 14 days – 75%
• 0 – 7 days – 100%
Plus any supplier charges that may apply.
CREDIT CARD PAYMENTS
Your authorization to use your Credit Card number for deposit and/or final payment indicates your compliance with our booking Terms and Conditions, whether or not you have actually signed the appropriate credit card slip. Verbal authorization and email authorization of your credit card confirms your reservation.
The vacation price confirmed to you at time of booking is guaranteed against any increase. Only government or civil aviation action in respect of airport taxes or consumer levies can affect price guarantees. Packages listed on the website are subject to availability of both accommodation and flights at time of booking.
There are strictly no refunds for any unused services after the arrival date.
IF WE CHANGE YOUR VACATION
Whenever possible all changes will be advised without delay. Alternative comparable arrangements will be offered. This excludes cancellations due to Force Majeure.
IF WE CANCEL YOUR VACATION
We reserve the right to cancel your vacation for any reason. However we will not cancel your vacation within 8 weeks of departure unless it is for a reason outside of our control (see force majeure). If we have to cancel your vacation we will offer you a choice of:
1. An alternative vacation of comparable type, although if the alternative offered is at additional cost, the difference will be payable by you and any ‘No Surcharge Guarantee’ on the original booking will not apply.
2. A full refund of all monies paid.
Subject to any supplier charges that may apply.
We will not refund due to events beyond our control. For example bankruptcy of supplier, cancellation by and event/conference organizers, technical or maintenance problems with transport, changes imposed by airlines, the alteration of the airline or aircraft type, war or threat of war, civil strife, industrial disputes, health pandemics including Covid-19, natural disaster, bad weather (resulting in poor ski or snow conditions) or terrorist activity.
Operational decisions may be taken by air carriers and airports, resulting in delays, diversions or rescheduling. Vision The Atlantic Canada Co. has no control over such decisions and is therefore unable to accept responsibility for them. Vision The Atlantic Canada Co. or any person assisting or collaborating with it will not be liable for death, personal injury or illness unless resulting from the negligence of Vision The Atlantic Canada Co. or its servants in its contractual duty to exercise care in making arrangements for the client.
Upon receipt of your travel documentation, it is your responsibility to verify all details are in accordance with your booking confirmation. Any discrepancies or queries should be addressed before travel.
Full passport or driving license with photograph is required from country of origin. For non-Canadian passport holders requirements should be checked with the relevant embassy. It is your responsibility to ensure that you have the correct passport and visas to gain entry to the countries included in your travel arrangements. If you fail to do so, we have no liability to you for any cost, loss or damage, which you suffer, nor will we refund you the cost of any unused portion of your travel arrangements.
IF YOU HAVE A COMPLAINT
If you have cause for complaint while on vacation you must bring it to the attention of the relevant authority, eg. hotel manager, airline supervisor, etc. at the time who will do their best to rectify the situation. It is unreasonable to take no action while on vacation, but to write a letter of complaint upon return. However should a problem remain unsolved, a complaint should be made in writing by fax, e-mail or mail to Vision The Atlantic Canada Co. within 14 days of completion of your vacation.
Temporary or permanent loss of baggage is the responsibility of the passengers or the carrier unless the loss occurs through negligence of Vision The Atlantic Canada Co.
It is the responsibility of the client to cover themselves and all members of their party with full vacation insurance including Covid-19 coverage (medical, cancellation and trip Interruption).
